   Overview: The various federal and/or state employment/labor discrimination laws, prohibit discrimination on the basis of race, color, religion, national origin, sex (including sexual harassment), age (those over 40), disability, or status as an active duty service member or veteran.  The employers subject to the statutes, procedural requirements, statutes of limitations, and remedies available differ based upon the statute(s) under which a discrimination claim is asserted. It is therefore crucial for employers and employees to be aware of the details of the particular statutes that could potentially apply to certain types of claims.
    
    The statutes reach all forms of conduct by employers, including recruitment practices, hiring decisions, pay levels, working conditions, training, evaluations, promotions terminations, and employee benefits.  Employers can violate the law not merely when they intend to treat an employee differently because of the employee’s “protected classification,” but also when they utilize employment practices that appear nondiscriminatory, but that have a significant adverse impact on a protected class.  Employer practices that have the effect of being detrimental to older, minority, female, or disabled employees or applicants, must be justified by business necessity.
